danieal kelly disabled girl left to starve to death

i am finding it hard to not think of this little boy at this time of year wondering if he ever had a christmas or any other child in the same situation.it breaks my heart.but i keep myself so busy i dont have time during the day to think of him but at night i often do.my husband says i should put it all behind me i often do but something always stirs to make me think of him.it angers me so amy baker walks around as if she doesnt let it bother her knowing she killed a child how can she live with herself?how can she wake each morning and not have regrets for what she has done.one day she will feel the same pain and tourture that she put that boy though.i am sorry for going on and on but when i write about my feelings and thoughts about this i often feel alot better and i do feel better now i just had to write tonight.good night everyone and god bless and have a merry christmas.god bless you marcus.

Cameras greeted Amy Baker as she arrived at Mason County Detention Center Wednesday night.

Escorted by Sheriff Patrick Boggs as well as a female employee of the sheriff's office, Baker made the transition from the Clermont County jail where she has been housed since April to the detention center in a white Crown Victoria. She hid from the cameras behind the tinted windows of the unmarked car, lying low in the backseat to avoid being photographed.

Baker's arrival comes more than a month and a half since the arrest warrant was first issued for her and after a lengthy extradition battle. She has been charged with tampering with physical evidence, a class D felony, in connection with the death of 3-year-old foster child Marcus Fiesel.

As the star witness in the case against Fiesel's foster parents, Liz and David Carroll, Baker was granted immunity in Hamilton and Clermont counties in Ohio. During open testimony, Baker admitted she and David Carroll burned the child's body and disposed of his remains by throwing them off the William Harsha Bridge spanning the Ohio River. The river is in Kentucky's jurisdiction.

Fiesel died after being bound in a blanket and packing tape and being left in a closet in the Carroll's home in Clermont County while the family attended a family reunion in Kentucky. He was dead when the family returned two days later.

Because her testimony resulted in the convictions of both Liz and David Carroll, prosecutors in Ohio as well as Baker's attorney, Norm Aubin, have maintained the charges against Baker in Mason County should not have been filed. Aubin has said the investigation into Fiesel's death was an Ohio investigation which should have closed with the conviction of the Carrolls.

Baker waived extradition only a week after Ohio Gov. Ted Strickland signed a warrant for her extradition.

While housed in Mason County, Jailer Gerald Curtis said Baker will be kept in protective isolation, at least initially.

"We're not actually anticipating any problems," Curtis said, citing the isolation was simply a "precautionary measure."

Upon being booked at the center, Curtis said Baker will be issued the standard detention center attire. She will also be given a phone card, a booklet outlining how commissary works, conduct expectations, general rules and her rights, as well as any personal items she may need.

"She'll get recreation and visits ... and she can have access to her attorney and mail, just like any other inmate," Curtis said.

While in isolation, Curtis said Baker will be able to write letters and listen to the radio.

Baker will be checked on every 20 minutes, Curtis said, as part of the routine within the detention center, and deputies may or may not speak to her at those times.

According to Mason County Attorney John Estill, Baker will likely be arraigned Monday in district court. As is the scenario with all inmates at the detention center, her arraignment will be made via video unless she is bonded out.

Bond for Baker in Clermont County was set at $50,000 -- the same amount set by Judge W. Todd Walton II when Baker's warrant was first issued in Kentucky. Estill said bond is set at the judge's discretion.

I don't know if any of you have heard about this case. I know I didn't until this past weekend. It's another sad story of an innocent 3 year old, dying at the hands of a caregiver. But this case it much more violent in nature, this poor child was tortured, he was raped, and beaten. No worries now Trustin, you can play in heaven with Marcus. another precious child dead

i just heard about this today.my husband went to see his friends that he visits often and the woman had her brother and his kids living with her for awhile cause he left his wife and was in the process of divorcing her.well one weekend the wife and her boyfriend came and got the kids for the weekend even though see said many times she didnt want them.well one night they took the 2 year old girl tried to kill her by overdosing her with alcohl when that didnt work they took bare wire and stuck them to the bottoms of her feet and electricuted her and then wrapped her up in a blanket where she smothered to death and then after she died they beat her little body and broke several bones.this is such a heart wreching story i cried for this little baby and still do my husband is taking it hard cause he saw the little girl all the time and said she was the cutes little thing very sweet.the family and the father is so upset and angry they tried to get the kids from this woman they fought and fought with childrens services and the cops and they REPEATEDLY SAID the woman hasnt broken any laws and their were no signs of abuse so their wasnt anything they can do.and this woman said i refuse to let my f****** family or husband have custody of the kids.and sadly the 4 yeard watched everything that happened but he did tell them everything he saw and they are in jail.now i havent asked what her name was cause i dont think he knows himself he just saw her a couple of times,this happened in bowling green kentucky i guess a month or so ago.i just dont understand why do people hurt and murder chidren?why what does it acomplish?it hurts me when i hear about such things i try not to read the news or watch it.it angers me so much they would do this what did she do for them to put her though so much tortoure.that little boy is scared for life now.i hope they get the death penity for this i cant even come up with anything to call them right now im that upset.if anyone knows the name of this baby let me know so i can use her name in future posts instead of just a child.god bless you little one may god hold you close and give you the love that your mom never gave you.

MAYSVILLE, Ky. -- The Mason County grand jury has indicted Amy Baker and David Carroll on felony charges of tampering with physical evidence.

Baker was a live-in girlfriend of David and Liz Carroll, the foster parents convicted in the murder of 3-year-old Marcus Fiesel last August.

Copies of the indictments were obtained by the Enquirer at 12:15 p.m.

Baker is expected to be arraigned at about 1 p.m. today, where bond will be set.

The 26-year-old Brown County woman had spent close to 60 days in Ohio and Kentucky jails after being arrested on the tampering charges in April.

She is currently out on bond.

A Mason County grand jury may issue a report today on charges that Amy Baker tampered with evidence in helping to dispose of 3-year-old Marcus Fiesel's remains.

The grand jury met July 13. It did not issue a report at that time.

The judge overseeing the grand jury was presiding over a trial in another county. That meant the jurors had to wait to deliver any indictments until their next meeting, which is today.

Liz Carroll, 31, was convicted of murder and several other charges in February. She will not be eligible for parole for 54 years. Following his wife's conviction, David Carroll Jr., 30, accepted a plea agreement with prosecutors. He will be eligible for parole in 16 years.

During Liz Carroll's trial, Baker admitted to destroying evidence after the boy's body was doused with gasoline and set on fire not far from Baker's Brown County childhood home.

What remained of the boy's 30-pound body was placed in a garbage bag and dumped in the Ohio River from a bridge near Maysville.

So it was decided today that the Carroll's 4 children go and stay with their paternal grandmother temporarily. I just have a quick question cause my mind is drawing a blank. Which side of the family had the reunion that Marcus didn't attend? Either way the judge should not allow this side of the family custody whatsoever. Didn't anybody at the reunion ask Where's Marcus? And now they want custody of the other children? This whole thing is disgusting. How were these two people allowed to adopt a child while having 4 of their own? It looks to me like they weren't fit to raise 1 let alone 5. David's mom looks like she can't support herself and she wants to raise these 4 children. How? These children deserve to be with a family that can support all 4 of them and more importantly love them. It looks like the grandparents are just out for publicity. Their children are sickos and deserve to be in prison for the rest of their lives.

I'm glad to hear that Marcus will finally be laid to rest. I'm sorry that I can't be there, I so very badly want to be, but I will not be able to attend his service, my court hearing conflicts with the time. I will however make it out to the cemetery very soon. So if any of you attend, please keep me in mind, I would love to be there also.

cause the other day i saw it and their was these robbers who went into this house their were 3 of them and one of them pulled the trigger and killed the person living there but yet all three got charged with capital murder even though only one pulled the trigger and killed him.i know its adifferent type of crime but the outcome was some one died and three were responsable and got punished for it.so i cant understand how amy hasnt been charged with murder too.i should get a copy of it and send it to breyers,deters and anyone else let them see how real justice is all about.as for the bakers spying on here if they cant take the heat then get out of the kichen and dont come here.they are just trying to get as many people in trouble because they are angry bitter nasty people who wants to bring misery to every one.well one day they will try something on some one and they wont take it and f*** them up.theirs always some one bigger and badder than you as my husband says and they will find that person and they will regret opening their big mouths.as far as im concerned about tinabeans that amy baker lover she can go to he** right with them and she will and no tina i dont have secrets like your friends or maybe you are a family member.the bakers are worthless piece of sh**s.god will punish them they need to listen to johnny cashes song gods gonna cut you down that message is loud and clear.

Is it a coincidence that Amy Baker married into the Baker family, the same Baker family that was in the news years ago with the disappearance of Carrie Culberson? Then Amy said she remembered that chimney from her childhood. Maybe she saw someone using that chimney to dispose of another missing person. It was about this time that a young Amy Baker was starting her relationship with the Baker boy.

Hmmmmm....

Maybe the investigators in the Carrie Culberson case just got some pretty good evidence of what might have happened almost 10 years ago from what happened to a little boy last year. Dig deeper in that dirt, how many other missing person's are the Baker's responsible for?

CINCINNATI -- Just days before a court-imposed deadline, Liz Carroll filed an appeal Thursday of her murder conviction.

Carroll and her husband, David Carroll, were convicted in February in the death of their 3-year-old foster son, Marcus Fiesel.

Liz Carroll’s attorney cited a number of errors the presiding court allegedly made in the murder trial

The attorney said Judge Robert Ringland should have disallowed Carroll’s grand jury testimony and moved the trial out of Clermont County, where the case had attracted sensational publicity in the months since Marcus was first reported missing.

"(Liz Carroll) does not receive a fair trial when the jury pool is so tainted by pretrial publicity that it is impossible to seat a jury which has not been exposed to such publicity to the extent that jurors seated have admitted forming opinion about (her) guilt, even if they agree to put those opinions aside," the attorney said in a motion for appeal.

The attorney also said the jury should not have entered separate convictions for other charges, such as kidnapping and involuntary manslaughter, connected to Marcus's death.

Amy Baker, who lived with the Carrolls, told a Hamilton County grand jury in August that the developmentally disabled boy had died earlier that month when Liz and David Carroll wrapped him in a blanket and placed him in a closet while they left town.

Baker, who testified at Liz Carroll’s murder trial in exchange for immunity from prosecutors, was transported late Wednesday to Kentucky, where she is charged with tampering with evidence related to the case.

Liz Carroll’s attorney said prosecutors had not presented enough evidence at the trial to support the murder conviction.

Baker testified that she helped David Carroll dump the charred remains of Marcus into the Ohio River.

Liz Carroll, 31, was sentenced to 54 years to life in prison after a jury convicted her of murder and six other charges, and David Carroll was sentenced to 16 years to life in prison after he pleaded guilty to murder and other charges.

I can answer the questions you asked on your show today. 1. Woody Breyer assisted Amy Baker with her lies. He knows that she was responsible for Marcus' death. 2. Marcus was not abused in my home, that too is another lie - I'm not sure if that was Amy's or Woody's. 3. All of my children and her 3 children were interviewed by CPS before we were arrested and all 7 of them said that NO ONE was mean to Marcus. 4. Then supposedly in February Woody Breyer claimed that Marcus was abused and my children were witnesses after 7 months of being kept away from anyone and everything they have ever known. 5. Breyer only read part of a statement made by my 7yr old son,. He told CPS that Dave taped his arms when he was trying to catch a football. He was asked if he was scared and he said no, it was to help him catch a football but of course,Breyer only said that "Dave taped one of our children." Those words alone go very well w/his story. 6. Breyer has threatened Dave - he said if he went to trial and testified then our kids would NOT be placed with family -if he took the plea, Woody would recommend that they be placed w/family. 7. Breyer cares only about a win not true justice. He made a deal w/the wrong person and doesn't care that Amy caused Marcus' death.

Here's something to think about...If Dave and I did what she claims, do you really think we would allow her out of our sight?? She stayed w/her Mom and husband between the 4th and 28th more than once. We didn't expect her to turn it around on us b/c she was already worried about me "cracking". At one point she even told Dave that they needed to get rid of me!

I'm not sure exactly what is normal in the justice system. I believe that Pipemeier has presented his cases based on the laws and NOT manipulative stories and lies. Breyer helped Amy lie and say she was with me when she taped & killed Marcus. She somehow "knew" what was on my shopping receipts but "couldn't remember" anything when my atty asked her questions.

To sum it up! I'm not convicted b/c I committed murder - I'm convicted b/c I lied but I didn't have a prosecuter guiding me through them. Then he used my children as pawns just like he did her. They have unsubstantiated abuse or neglect w/my children so they have kept them, for 8 months claiming dependancy when there were 4 family members at the juvenile court to try to get them. My dad has a 1 hr visit per month. Amy sees her kids weekly & holidays & they have proven that she abused & neglected her children. I'm gonna answer your question! Yes - the Clermont Court justice system is all political. Don White & Woody Breyer HAVE used their power and promises to get the story they wanted instead of justice. Amy, Dave, and myself should have to do our own time for the crimes each of us commited. I got 14-1/2 years for my lies and I'm hoping for a lesser sentence but if not - it's what I did! I was afraid and wanted to tell but I didn't and that's my own fault.

Now how many murder cases exist where DNA & forensics testing is NOT even attempted. They did no testing on the crib for skin cells or fingerprints on any of the rolls of tape they took. Did anyone tell you that Amy's husband went into my house and removed something in a small bag while Amy and I were at the grand jury? What did Amy want removed from my house before the detectives got to it? Brian told his girlfriend that he was getting the kids school clothes that I bought them. But those were given to him and Amy on Sat 8/26. Amy claims that he got blankets amd pillows but those were not picked up until my family packed my house in September. There is an eyewitness that says he left w/something small in one hand and a small bag in the other and there are pics of his vehicle at the chimney. What would he be doing there? Unfortunatley, the state did not investigate what Amy told them. They just accepted it and used the media to convict me by replaying the story over & over for 7 months. The truth still hasn't been released but I'm sure that it will be in KY or Cleveland if I get another trial.

She told the same lies that Dave and I did to the detectives. She added more to save herself and was streetsmart enough to get immunity. She's always "smart" enough to get away from prosecution with many deception crimes (prescription fraud, tax fraud, welfare fraud, theft, forgery, and credit card fraud) and now murder, involuntary ms, felonious assault, kidnapping, end children,, making false alarms, inducing a panic, perjury, and obstruction of justice. I wouldn't be suprised if Amy pleads guilty to "tampering with evidence" b/c she knows that Dave is gonna trestify to "everything" that she did to Marcus to cause his death and after to cover his death. I see her pleading guilty to avoid the truth from coming out unless she feels cocky w/Breyer in her corner.

BUT IT SEEMED HOPELESS. HE JUST DID NOT HAVE ANY INBORN ABILITY. I ONLY KNEW HIS MOTHER FROM A DISTANCE AS SHE DROPPED ROBBY OFF OR WAITED IN HER AGED CAR TO PICK HIM UP. SHE ALWAYS WAVED AND SMILED BUT NEVER STOPPED IN.

THEN ONE DAY ROBBY STOPPED COMING TO OUR LESSONS.I THOUGHT ABOUT CALLING HIM BUT ASSUMED BECAUSE OF THE LACK OF ABILITY,THAT HE DECIDED TO PURSUE SOMETHIN ELSE.HE WAS BAD ADVERTISMENT FOR MY TEACHING!

SEVERAL WEEKS LATER I MAILED TO THE STUDENTS HOMES A FLYER ON THE UPCOMING RECITAL. TO MY SURPRISE ROBBY(WHO RECEIVED A FLYER) ASKED ME IF HE COULD BE IN THE RECITAL.I TOLD HIM THAT THE RECITAL WAS FOR CURRENT PUPILS AND BECAUSE HE HAD DROPPED OUT HE REALLY DID NOT QUALIFY.HE SAID THAT HIS MOTHER HAD BEEN SICK AND UNABLE TO TAKE HIM TO PIANO LESSONS BUT HE WAS STILL PRACTICING'MISS HONDORF I'VE JUST GOT TO PLAY!' HE INSISTED.I DON'T KNOW WHAT LED ME TO ALLOW HIM TO PLAY IN THE RECITAL. MAYBE IT WAS HIS PERSISTENCE OR MAYBE IT WAS SOMETHING INSIDE OF ME SAYING IT WOULD BE ALL RIGHT.

THE NIGHT FOR THE RECITAL CAME.THE HIGH SCHOOL GYMNASIUM WAS PACKED WITH PARENTS,FRIENDS AND RELATIVES.I PUT ROBBY UP LAST IN THE PROGRAM BEFORE I WAS TO COME UP AND THANK ALL THE STUDENTS AND PLAY A FINISHING PIECE.I THOUGHT THAT ANY DAMAGE HE WOULD DO WOULD COME AT THE END OF THE PROGRAM AND I COULD ALWAYS SALVAGE HIS POOR PERFORMANCE THOUGH MY 'CURTAIN CLOSER.'

WELL ,THE RECITAL WENT OFF WITHOUT A HITCH.THE STUDENTS HAD BEEN PRACTICING AND IT SHOWED. THEN ROBBY CAME UP ON STAGE.

HIS CLOTHES WERE WRINKLED AND HIS HAIR LOOKED LIKE HE'D RUN AN EGGBEATER TROUGH IT.'WHY DIDN'T HE DRESS UP LIKE THE OTHER STUDENTS?'I THOUGHT.'WHY DIDN'T HIS MOTHER AT LEAST MAKE HIM COMB HIS HAIR FOR THIS SPECIAL NIGHT?'

ROBBY PULLED OUT THE PIANO BENCH AND HE BEGAN. I WAS SUPRISED WHEN HE ANNOUNCED THAT HE HAD CHOSEN MOZART'S CONCERTO#21 IN C MAJOR.I WAS NOT PREPARED FOR WHAT I HEARD NEXT.HIS FINGERS WERE LIGHT ON THE KEYS, THEY EVEN DANCED NIMBLY ON THE IVORIES. HE WENT FORM PIANISSIMO TO FORTISSIMO.FROM ALLEGRO TO VIRTUOSO. HIS SUSPENDED CHORDS THAT MOZART DEMANDS WERE MAGNIFICENT! NEVER HAD I HEARD MOZART PLAYED SO WELL BY PEOPLE HIS AGE. AFTER SIX AND A HALF MINUTES HE ENDED IN A GRAND CRESCENDO AND EVERYONE WAS ON THEIR FEET IN WILD APPLAUSE. OVERCOME AND IN TEARS I RAN UP STAGE AND PUT MY ARMS AROUND ROBBY IN JOY.'I'VE NEVER HEARD YOU PLAY LIKE THAT ROBBY!HOW'D YOU DO IT?

THROUGH THE MICROPHONE ROBBY EXPLAINED: 'WELL MISS HONDORF...REMEMBER I TOLD YOU MY MOM WAS SICK?,WELL,ACTUALLY SHE HAD CANCER AND PASSED AWAY THIS MORNING AND WELL...SHE WAS BORN DEAF SO TONIGHT WAS THE FIRST TIME SHE EVER HEARD ME PLAY.I WANTED TO MAKE IT SPECIAL.'

THERE WASN'T A DRY EYE IN THE HOUSE THAT EVENING.AS THE PEOPLE FROM SOCIAL SERVICES LED ROBBY FROM THE STAGE TO BE PLACED IN FOSTER CARE,I NOTICED THAT EVEN THEIR EYES WERE RED AND PUFFY AND I THOUGHT TO MYSELF HOW MUCH RICHER MY LIFE HAD BEEN FOR TAKING ROBBY AS MY PUPIL.

NO,I'VE NEVER HAD A PRODIGY BUT THAT NIGHT I BECAME A PRODIGY OF ROBBY'S. HE WAS THE TEACHER AND I WAS THE PUPIL FOR IT IS HE THAT TAUGHT ME THE MEANING OF PERSEVERANCE AND LOVE AND BELIEVING IN YOURSELF AND MAYBE EVEN TAKING A CHANCE IN SOMEONE AND YOU DON'T KNOW WHY.

ROBBY WAS KILLED IN THE SENSELESS BOMBING OF THE ALFRED P. MURRAH FEDERAL BUILDING IN OKLAHOMA CITY IN APRIL OF 1995.

AND NOW A FOOTNOTE TO THE STORY.IF YOU ARE THINKING ABOUT FORWARDING THIS MESSAGE,YOU ARE PROBABLY THINKING ABOUT WHICH PEOPLE ON YOUR ADDRESS LIST AREN'T THE 'APPROPRIATE' ONES TO RECIEVE THIS TYPE OF MESSAGE. THE PERSON WHO SENT THIS TO YOU BELIEVES THAT WE CAN ALL MAKE A DIFFERENCE.

I have started the petition. It will be on Channel 5 news at 5 and 6 o'clock. If you are interested in signing or helping get signatures, please contact me. I am also thinking of having one or two days in the near future, where I set up at a park or something and have the news cover it so it gets out more, so people can come and sign.

I'M URGING YOU TO EMAIL THE COMMONWEALTH ATTORNEY FOR MASON COUNTY KY!!!!!!!!

I have emailed ,Kathryn B Hendrickson at kbhendrickson@kyprosecutors.com and asked her not to testify in the extradition hearing Amy Baker is supposed to have on May 17,I Believe.

Told her she would be turning her back on not only her colleague in Maysville that wants the charges,but the citizens of KY as well.

PLEASE FLOOD HER WITH EMAILS OF DISAPPROVAL OF HER ACTIONS,IF SHE GOES TO OHIO TO TESTIFY THAT SHE DOESN'T WANT CHARGES ON BAKER,IT'S POSSIBLE THEY WON'T EXTRADITE.
